TERMS AND CONDITIONS FOR PARTICIPATION IN

THE CRESTA SIDE HUSTLE SERIES

 

By applying for and participating in The Cresta Side Hustle Series (known herein as the "Initiative") in association with the University of Johannesburg and Cresta Shopping Centre, you agree to the below Terms and Conditions. The Promoters of the Initiative are Cresta Shopping Centre and AVLM Communication Solutions.

1. Eligibility

  • The Website is intended for use by individuals aged 18 and above. Furthermore, the Initiative is open to citizens or permanent residents of the Republic of South Africa aged 18-25 years old.

  • By submitting your CV through this Website, you confirm that:

  • you are at least 18 years old on the date of submitting your CV;

  • the personal information in the CV is correct;

  • you understand that the skills workshop provided through the Initiative does not replace formal education, training and/or qualifications;

  • you acknowledge and accept that the skills workshop provided through the Initiative is designed to impart the skills necessary to perform the specific tasks required to fulfil the key objective and output of the Initiative;

  • you understand that there is no guarantee of employment or placement in any position, or follow-up communication;

  •  you consent to and hereby grant the Promotor permission to use and disclose your personal information (being name, likeness or comments for publicity purposes on social and/or other media selected by the Promotor without payment of any consideration;

  •  you acknowledge that you may be requested by the Promotor for a photograph and to publish your information for publicity purposes. You will be afforded the opportunity to decline such an invitation. Should you agree to participate in such photographic and publishing opportunity, you will not receive, nor be entitled to any payment or consideration for such publicity. Any and all publicity material and /or photographs shall remain the sole property of Cresta Shopping Centre.

  • Applicants must submit a fully completed application form (which is available on www.crestasidehustle.co.za) by the specified deadline.

  •  Successful applicants (i) will be selected based on the information provided in the completed application form and CV; and (ii) must commit to completing all required tasks forming part of the Initiative.

  • The selection decision of participants is final, and no correspondence will be entered into.• Only residents of the community surrounding Cresta Shopping Centre are eligible to apply.

  • Applicants may not participate in the Initiative if they are a Director, Member, Partner, Employee, Tenant (or employee of a Tenant), Agent, Consultant or Supplier to the Promoters, or their respective Spouses, Partners, Family Members (Parents, Siblings and Children), Business Partners or Associates.

2. Submission of CV’s

  • The Website serves as a platform to collect CVs from eligible applicants for potential participation in the Initiative.

  • Despite participation in, and completion of the Initiative, there is no guarantee of employment or placement in any position, or follow-up communication.

  • All applications must be truthful, accurate, and complete. Applicants are responsible for ensuring the information provided in their CV is correct and up to date.

3. Commitment

 

  • Participants are required to:

  • Attend the compulsory in-person Skills Workshop on the date and at the venue as communicated by the Promotors.

  • Conduct at least 10 interviews with pre-determined / selected questions with a mix of peers, family, and community members as part of the Initiative.

  • Submit the results of the interviews to the Promotors in the format as required by the Promotors on the date as communicated by the Promotors.

  • Failure to attend the compulsory Skills Workshop and meet the interview and project completion requirements may result in your disqualification and removal from continued participation in the Initiative. In such instance, participants will be required to return all material received as part of the Initiative to the Promotors.

4. Responsibilities of Participants

  • Participants must conduct interviews professionally, respectfully, and with integrity.

  • Any misrepresentation or unethical behaviour during the interviews or data collection process will result in immediate disqualification and removal from continued participation in the Initiative, and any future opportunities forming part of the Initiative.

  • Participants are responsible for managing their time and ensuring that all tasks associated with the Initiative are completed within the deadlines provided.

5. Data Collection and Confidentiality

  • As part of the Initiative, participants may collect personal information from interviewees. Participants agree to comply with the Protection of Personal Information Act of 2013 (POPIA) and ensure that all collected data is handled with care and confidentiality.

  • Personal information obtained during the interviews must be used solely for the purposes of the Initiative and must not be shared with third parties without prior written consent or as may be required by law.

  • All submitted application information and that of the interviewees as received from the participants will be stored and protected by the Promotors in accordance with POPIA.

6. Use of Findings

  • The data collected during the interviews will be used by the Promotors for research and to highlight community comments / responses as part of the Initiative’s objectives.

  • By participating in the Initiative and submitting the results of the interviews and/or interviews in a format as required by the Promotors, the Participant agrees that the findings and insights from their interviews may be used in reports, presentations, and/or other materials related to the Initiative by the Promotors.

  • No personal data from the interviews will be shared publicly without the interviewee’s prior written consent. The Participant therefore needs to ensure that the personal data is correct to enable the Promotors to contact such interviewee to obtain such consent.

7. Payment

  • Participants will receive compensation for conducting and completing the required interviews. Payment details, including amount and method of payment, will be provided once the Participant is accepted into the Initiative. The amount of compensation for participating in the Initiative is not negotiable.

  • Payment is contingent upon the attendance of the compulsory Skills Workshop, completion of the required 10 interviews as set out above and the submission of interview data in a format agreed to by the Promotors by the agreed date.

  • Any and all associated subsistence and travel costs shall be borne by the participant.

  • All prizes and incentives are neither negotiable nor transferable and may not be exchanged for cash. All prizes and incentives may be subject to additional terms and conditions not mentioned hereunder, but in accordance with relevant South African legislation. The Promoters reserve the right to substitute a prize or incentive of equal or greater value if any original prize becomes unavailable for any unforeseen reason.

8. Withdrawal

  • Participants may withdraw from the Initiative at any time, but a pro rata portion of the compensation will only be made based on the interviews conducted and tasks completed up to the point of withdrawal.

9. Limitation of Liability

  • The Promotors and the University of Johannesburg, shall not be liable for any loss, damage, injury, or death arising from participation in the Initiative.

  • Participants in the Initiative hereby indemnify, release and hold harmless the Promoters, organizers and their successors, employees, officers, suppliers, contractors, agents, consultants, directors and shareholders from and against any losses, claims, proceedings, actions, damages, liability for harm, injury or death, demands, expenses or any costs howsoever arising out of their participation in the Initiative or their use of the compensation.

  • The laws of the Republic of South Africa govern the Initiative.

  • The Promoters reserve the right to cancel, modify or amend the Initiative at any time if deemed necessary in their own discretion or if circumstances arise outside of their reasonable control.

  • The Promotors, organizers and their successors, employees, officers, suppliers, contractors, agents, consultants, directors and shareholders, disclaim any liability for damage to any computer system resulting from access to or the download of information or materials connected with the Initiative.

10. Code of Conduct

  • All Participants are expected to behave respectfully and professionally during their participation in the Initiative, including during interviews and when interacting with fellow participants, interviewees and the Promotors.

  • Any violation of this code of conduct may result in the immediate disqualification and removal from continued participation in the Initiative, and any future opportunities.

11. Changes to Terms and Conditions

  • The Promotors reserve the right to modify these Terms and Conditions at any time. Participants will be informed of any changes that may affect their participation.
